Theft By Unlawful Taking or Disposition(N.J.S.A. 2C:20-3)


Theft of Movable Property:  Under N.J.S.A. 2C:20-3(a), a person is guilty of theft if he unlawfully takes, or exercises unlawful control over, movable property of another with the purpose to deprive him or her of that property.


“Movable Property” Defined: “Movable property” means property, the location of which can be changed.  See N.J.S.A. 2C:20-1(e).


Theft of Immovable Property:  Under N.J.S.A. 2C:20-3(b), a person is guilty of theft if he or she unlawfully transfers any interest in immovable property of another with the purpose to benefit himself or another not entitled to that property.
